Dr. Maryam Adibfar’s Facebook “Like” Giveaway
OFFICIAL CONTEST RULES AND REGULATIONS
1. Sponsors: Dr. Maryam Adibfar’s Giveaway Contest (the “Contest”) is sponsored by Dr. Maryam Adibfar Professional Dentistry Corporation.
2. Eligibility: the “Contest” is only open to legal residents of Toronto, Ontario, Canada or locations that make up the “Greater Toronto Area” who have reached the age of majority in the province of residence at the time of entry, with the exception of: employees of the Sponsors, their respective parent, related and affiliate companies, subsidiaries, franchisees, suppliers, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials, and members of the immediate family (spouse, parent, siblings and children) and those living in the same household as the foregoing.
By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules, including but not limited to the eligibility requirements set out herein. Entrants who do not comply are subject to disqualification.
3. Contest Dates and Times: The Contest begins on the first of each month at 12:01 a.m. Eastern Standard Time (“EST”) and will end on the last day of that month at 11:59 p.m. EST (the “Contest Period”), after which time the Contest will be closed and no further entries shall be accepted. The sole determinant of time for the purpose of a receipt of a valid entry will be Indigo’s server machines.
4. How to Enter: There are two (2) ways to enter the Contest during the Contest Period. NO PURCHASE IS NECESSARY.
- “Like” Dr. Maryam Adibfar Professional Dentistry Corporation on Facebook: visit our facebook page https://www.facebook.com/MaryamAdibfarDentistry and “like” our facebook page, you will receive one (1) entry into the Contest; or
- Alternate mode of entry – no purchase necessary: if you have already “liked” our facebook page you can be eligible to receive two (2) entries into the Contest by “submitting a photo of your smile” on our https://www.facebook.com/MaryamAdibfarDentistry page.
5. LIMIT of one (1) entry per person per email/Facebook account per Calendar month during the Contest Period, up to a maximum total of three (3) entries, regardless of mode of entry used. If your name is drawn, you will only be declared a winner if you meet the eligibility criteria set out herein.
You may use only one (1) e-mail account/Facebook account to participate in the Contest. Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple loyalty memberships, email accounts, identities, or registrations, shall be deemed as tampering and may disqualify you from entering, participating, winning the prize, and preclude you from participating in future contests and promotions of the Sponsors, at their sole discretion. Entry forms that contain false or incomplete information may be void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions the Contest Rules will be judged void. All entries become the property of the Sponsors upon receipt and none will be returned. No correspondence will be entered into except with selected entrants. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Sponsors’ server machine(s).
6. Prizes: There is two (2) total prizes available to be won each month, comprising of one (1) electric tooth (make and model to be determined by the Sponsor) and a $35 Starbucks gift card (“Prizes”). Prizes will be awarded in the form of an electric toothbrush (valued at no more than $25 CDN dollars) and a Starbucks gift card (valued at $35 CDN dollars).
Limit of one “prizes” per person. The Prizes must be accepted as awarded and cannot be substituted, except at the sole discretion of the Sponsors. The Sponsors reserve the right, in their sole discretion, to substitute a prize of equal or greater value if the Prize cannot be awarded as described for any reason.
Prizes will be distributed within 30 days after the Winners have been selected subject to the eligibility criteria.
ODDS OF WINNING: THE ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED DURING THE CONTEST PERIOD.
7. Random Draw and Winner Confirmation: On or around the final day of a given month (the “Draw Date”), an employee of Dr. Maryam Adibfar Professional Dentistry located at 1849 Yonge Street, Suite 508, Toronto, ON, M4S 1Y2 will conduct a random draw from all entries received during the Contest Period to select one (1) selected entrants. The selected entrants will only win the prizes if they meet the eligibility criteria set out in these Contest Rules. If a selected entrant does not meet the eligibility criteria, he/she will be disqualified and will not receive a prize and another entrant will be selected by way of a random draw. Before being declared a winner, the selected entrant will be required to
- 1. Correctly answer, without assistance of any kind (whether mechanical or otherwise), a time-limited mathematical skill-testing question to be administered during a pre-arranged telephone call or by e-mail,
- 2. Comply with these Contest Rules and,
- 3. Sign and return a Declaration and Release form, discussed below.
8. THE SELECTED ENTRANTS WILL BE NOTIFIED BY E-MAIL/TELEPHONE OR FACEBOOK PRIVATE MESSAGE WITHIN FIVE (5) BUSINESS DAYS OF THE DRAW DATE. The selected entrants will be contacted by e-mail or telephone or Facebook private message to the e-mail address or phone number or Facebook account used or provided upon entry into the Contest, or which is associated with the selected entrants’ Facebook or email address. Upon notification, the selected entrants must respond to Dr. Maryam Adibfar Professional Dentistry Corporation by e-mail: [email protected] or telephone: 416-486-1849 within five (5) business days of being contacted. If the selected entrant does not respond in accordance with these Contest Rules, he/she will be disqualified and will not receive a prize and another entrant will be selected in the same fashion (by random draw). The Sponsors are not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for the Sponsors to receive a selected entrant’s response. The winner must pick the prizes up at Maryam Adibfar Professional Dentistry Corporation office located at 1849 Yonge Street, Suite 508, Toronto, ON, M4S 1Y2 within 10 business days of being notified or the prizes will be forfeited and another random draw will be held at the Sponsors discretion.
Dispute regarding identity of entrant: If the identity of a selected entrant is disputed, the entry will be deemed to have been submitted by the “Authorized Account Holder”. The individual assigned to the e-mail address or Facebook account for the domain associated with the submitted e-mail address or Facebook account is considered to be the Authorized Account Holder. Each selected entrant may be required to provide proof that he/she is the Authorized Account Holder of the e-mail addresses or Facebook account associated with the selected entry.
9. RELEASE: each winner must sign a Declaration and Release form discharging and releasing the Sponsors, their respective parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies from any and all claims for damages, losses or injuries resulting from the Contest, use or misuse of the Prize, confirming compliance with the Contest Rules, and confirming acceptance of the Prize as awarded. Signed Declaration and Release forms must be returned to Dr. Maryam Adibfar Professional Dentistry Corporation by e-mail: [email protected]) or no later than 5:00 p.m. EST on the fifth day after the contest draw, for the prizes.
10. INDEMNIFICATION: Entrants release and hold harmless the Sponsors, their respective parent, related and affiliated companies, subsidiaries, members, dealers, advertisers, franchisees, promotional agencies and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest, from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage which the entrants, their heirs, successors or assigns might have or could have, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded.
The Sponsors are also not responsible for:
- Incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules;
- Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
- Lost, incomplete, delayed, mutilated or misdirected entries or Declaration and Release Forms;
- Injury or damage to entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize;
- Any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of the Prize;
- The security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; and,
- Late, lost, misdirected or unsuccessful efforts to notify potential winner.
11. CONDUCT: The Sponsors reserve the right, in their sole discretion, to disqualify any Entrant they find to be: (a) violating these Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest; (c) acting in an unsportsman-like or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any attempt by an Entrant or any other individual to undermine the legitimate operation of the Contest may be a violation of criminal and/or civil laws. Should any such attempt be made, Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law.
12. OTHER CONDITIONS
Publicity: By participating in the Contest, entrants consent to the use of their name, comments, city and province/territory of residence and image on videotape, photograph or other means in any publicity carried out by the Sponsors with respect to this Contest, without further notice or compensation.
Law: The Contest is void where prohibited by law and is subject to all applicable Federal, Provincial and Municipal laws. The Contest and these Rules shall be governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and any dispute shall be adjudicated by the courts sitting in Toronto, Ontario.
Privacy: The Sponsors respect your right to privacy and will collect and use your personal information only to administer the Contest.
The Sponsors reserve the right, in their sole discretion, to amend or modify these Contest rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsors corrupts, or threatens to corrupt, the security or proper administration of the Contest.
Intellectual Property: All intellectual property, including but not limited to trade marks, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are individually owned by the Sponsors. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of its owner is strictly prohibited.
